9-101 General Requirements

Use for Intended Purpose	9-101.11	General Requirements
	(A) MOBILE FOOD ESTABLISHMENTS, PUSHCARTS, and TEMPORARY FOOD ESTABLISHMENTS shall comply with the requirements of these regulations, except as otherwise provided in this section of the regulation. The regulatory authority may impose additional requirements to protect against health hazards related to the conduct of the food service establishment, may prohibit the sale of some or all POTENTIALLY HAZARDOUS FOOD, and when no health hazard shall result, may waive or modify requirements of these regulations relating to physical facilities as allows in § 8-103.11.
	(B) MOBILE FOOD ESTABLISHMENTS, PUSHCARTS, and TEMPORARY FOOD ESTABLISHMENTS serving only food prepared, packaged in individual servings, transported and stored under conditions meeting the requirements of these regulations, or beverages that are not potentially hazardous, and served in sealed containers need not comply with requirements of these regulations pertaining to the necessity of water and SEWAGE systems nor those requirements pertaining to the cleaning and SANITIZATION of EQUIPMENT and UTENSILS if the required EQUIPMENT for cleaning and SANITIZATION exists at a COMMISSARY.
	(C) MOBILE FOOD ESTABLISHMENTS, PUSHCARTS, and TEMPORARY FOOD ESTABLISHMENTS shall provide only single service articles for use by the consumer.
